Dr. Eraser Clinic Terms of Use

Chapter 1. General Provisions

Article 1 (Purpose)
These Terms and Conditions (the “Terms”) set forth the conditions and procedures for the use of all services (the “Services”) provided by Dr. Eraser Clinic (the “Clinic”) through its website, as well as the rights, obligations, and responsibilities of the Clinic and users.

Article 2 (Definitions)
The terms used in these Terms are defined as follows.
1. “User”: A person who receives the Services provided by the Clinic under these Terms
2. “Service Agreement”: A contract concluded between the Clinic and a User in connection with the use of the Services
3. “Sign-Up”: The act of completing the Service Agreement by entering information in the application form provided by the Clinic and agreeing to these Terms
4. “Member”: A person who has provided personal information for the use of the Services and completed member registration
5. “ID”: A combination of letters and numbers selected by the Member and approved by the Clinic for identification and use of the Services
6. “Password”: A combination of letters, numbers, and special characters set by the Member to protect member information
7. “Termination of Use”: An expression of intent by the Clinic or the Member to terminate the Service Agreement

Article 3 (Effect and Amendment of the Terms)
① These Terms take effect by being posted on the Service screen or announced via notices.
② The Clinic may amend these Terms as necessary, and the amended Terms take effect seven (7) days after the date of notice.
③ If a User does not agree to the amended Terms, the User may discontinue use of the Services and withdraw membership. If the User continues to use the Services after the notice period, the User is deemed to have agreed to the amendments.

Article 4 (Governing Provisions)
Matters not specified herein shall be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, and other applicable laws and regulations.

Chapter 2. Service Agreement

Article 5 (Formation of the Service Agreement)
The Service Agreement is formed upon the User’s application, the Clinic’s acceptance, and the User’s consent to these Terms.

Article 6 (Application for Use)
An application for use shall be made by entering the required information on the member sign-up page.

Article 7 (Acceptance of Application)
① If the information provided in the application is accurate, acceptance will be granted unless there is a special reason not to do so.
② Acceptance may be deferred or refused in any of the following cases:
1. The application is made under a name other than the applicant’s real name
2. The name or identity of another person is used without authorization
3. False information is provided in the application
4. The application is made for the purpose of undermining public order or good morals
5. The applicant fails to meet other requirements set by the Clinic

Article 8 (Changes to Contract Information)
If a Member changes any information provided at the time of application, the Member shall promptly update it. The Member bears responsibility for any consequences arising from failure to make such updates.

Chapter 3. Obligations of the Parties

Article 9 (Obligations of the Clinic)
The Clinic shall not provide or disclose a Member’s personal information to any third party without the Member’s consent, except as permitted under applicable laws and regulations.

Article 10 (Obligations of Members)
① Members shall not engage in the following acts:
1. Unauthorized use of another person’s ID or password
2. Unauthorized reproduction or distribution of information
3. Infringement of copyrights or other rights
4. Distribution of information in violation of public order or good morals
5. Acts connected with criminal activities
6. Any other acts in violation of laws and regulations
② Members shall not use the Services for business or commercial purposes; the Clinic assumes no responsibility for results arising therefrom.
③ Members may not assign, donate, or provide their membership rights as security to any third party.

Chapter 4. Use of Services

Article 11 (Service Hours)
Unless there are special operational or technical issues, the Services are provided 24 hours a day, year-round. However, the Services may be suspended for unavoidable reasons such as regular maintenance.

Article 12 (Management and Deletion of Posts)
For efficient operation, the size and retention period of posts may be limited, and the following posts may be deleted without prior notice:
1. Content that defames others
2. Content that violates public order or good morals
3. Content related to criminal activities
4. Content that infringes copyrights or other rights
5. Posting or linking of obscene materials
6. Any other content that violates laws and regulations

Article 13 (Copyright in Posts)
Copyright in posts belongs to the author. Unauthorized commercial use is prohibited.

Article 14 (Responsibility for Use of Services)
The Clinic is not liable for any service disruptions or damages caused by reasons attributable to the Member.

Article 15 (Suspension of Services)
The Clinic may suspend the provision of the Services in any of the following cases:
1. Maintenance, repair, or replacement of equipment
2. Suspension of services by the telecommunications carrier
3. When system inspections are necessary
4. In the event of force majeure

Chapter 5. Termination and Restrictions on Use

Article 16 (Termination)
A Member may request termination online, and the Clinic will process the request after verifying the Member’s identity.

Article 17 (Restrictions on Use)
If a Member falls under any of the following circumstances, the Clinic may, after giving thirty (30) days’ prior notice and hearing the Member’s opinion, terminate the Service Agreement or restrict the Member’s use:
1. Theft or misuse of another person’s ID or password
2. Interference with the operation of the Services
3. Submitting a false application for membership
4. Duplicate registration
5. Violation of public order or good morals
6. Defamation of others
7. Bulk transmission of information or advertisements (spam)
8. Distribution of malicious code or software (malware)
9. Infringement of intellectual property rights
10. Unauthorized use of personal information
11. Posting or linking of obscene materials
12. Any other violation of laws and regulations

Chapter 6. Miscellaneous

Article 18 (Prohibition on Assignment)
Members may not assign, donate, or provide as security their rights or contractual status to any third party.

Article 19 (Damages)
With respect to free Services, the Clinic shall not be liable for damages except in cases of willful misconduct or gross negligence.

Article 20 (Disclaimers)
① The Clinic shall not be liable in cases of force majeure, including natural disasters or war.
② The Clinic is not liable for damages arising from maintenance, repair, replacement, or regular inspection of equipment.
③ The Clinic is not liable for disruptions attributable to the Member.
④ The Clinic is not liable for lost expected profits or damage to data.
⑤ The Clinic does not guarantee the reliability or accuracy of information posted by Members.

Article 21 (Jurisdiction)
In the event of a dispute, the court having jurisdiction over the location of the Clinic’s principal place of business shall have exclusive jurisdiction.

Supplementary Provision (Effective Date)
These Terms have been effective since June 10, 2022.
